Copyright Dispute Policy

In compliance with the Digital Millennium Copyright Act (DMCA), Topcoolteez has implemented the following policy to address claims of copyright infringement. We reserve the right to:

  1. Block access to or remove any content we believe, in good faith, to infringe on copyrighted material illegally copied or distributed by advertisers, affiliates, content providers, members, or users of our services.
  2. Terminate services to repeat offenders who violate copyright laws.

Your use of Topcoolteez’s services is subject to our Terms of Service, which incorporate this Copyright Dispute Policy. Any terms not explicitly defined in this Policy carry the meanings assigned to them in the Terms of Service.

Reporting Copyright Infringement

If you believe that content accessible through our services infringes your copyright (or the copyright of someone you are authorized to represent), you may submit a copyright infringement notice to Topcoolteez’s Designated Agent. The notice must include the following information:

  1. A physical or electronic signature of the individual authorized to act on behalf of the copyright owner whose rights are allegedly infringed.
  2. Identification of the copyrighted work(s) claimed to have been infringed.
  3. Identification of the material claimed to be infringing, including sufficient detail to enable Topcoolteez to locate and verify the existence of the material (e.g., a URL or specific location).
  4. A statement that the notifier has a good faith belief that the use of the identified material is not authorized by the copyright owner, its agent, or applicable law.
  5. Contact information for the notifier, including name, address, telephone number, and email address (if available).
  6. A statement, made under penalty of perjury, that the information provided in the notice is accurate and that the notifying party is authorized to act on behalf of the copyright owner.

Actions Upon Receipt of a Proper Notice

Upon receiving a valid copyright infringement notice, Topcoolteez may take the following actions:

  1. Remove or disable access to the infringing material.
  2. Notify the content provider accused of infringement about the removal or disabling of access to the material.
  3. Terminate the content provider’s access to our services if they are determined to be repeat offenders.

Counter-Notice Procedure

If you, as the content provider, believe that the removed or disabled material is not infringing or that you are authorized to use it, you may submit a counter-notice to our Designated Agent. Your counter-notice must include the following:

  1. A physical or electronic signature of the content provider.
  2. Identification of the material that was removed or disabled and the location where it appeared before its removal or disabling.
  3. A statement that you have a good faith belief that the material was removed or disabled due to a mistake or misidentification.
  4. Your name, address, telephone number, and email address (if available), along with a statement that you consent to the jurisdiction of the Federal Court for the judicial district where your address is located. If you reside outside the United States, you must consent to the jurisdiction of any judicial district where Topcoolteez operates, and you agree to accept service of process from the person who filed the original copyright infringement notice.

Resolution Process

Upon receiving a valid counter-notice, Topcoolteez may, at its discretion:

  1. Provide a copy of the counter-notice to the original complainant, notifying them that the removed material may be restored or access re-enabled within 10 business days.
  2. Restore the removed material or re-enable access to it after 10 to 14 business days unless the original complainant files a legal action seeking a court order to prevent the alleged infringement.
